Club Registration Waiver
This is a legal document. Please read it carefully before accepting or signing.
This waiver applies to participation in Courtline activities and use of Courtline facilities. Effective September 11, 2026.
Acknowledgment of risk
I, the participant—or the parent or legal guardian signing for a minor participant—understand that taking part in activities at Courtline (the “Club”) involves inherent risks. Activities may include padel, pickleball, coaching, clinics, leagues, tournaments, events, fitness or warm-up activities, and use of the Club’s premises, courts and equipment.
Risks may include slips, trips, falls, collisions, contact with players, walls, glass, fences, paddles, rackets, balls or equipment; equipment failure; overexertion; dehydration; illness; aggravation of an existing condition; strains, sprains, fractures, head or spinal injury; cardiac events; paralysis; death; property loss or damage; and other risks associated with physical activity and an athletic facility. Risks may arise from my own actions, the actions of others, facility conditions or negligence.
Voluntary participation and assumption of risk
I choose to participate voluntarily and knowingly accept and assume the risks, dangers and hazards associated with Club activities and use of the premises. I accept responsibility for my safety and conduct and, where I sign for a minor, for the minor participant’s safety and conduct, subject to rights and responsibilities that cannot lawfully be waived.
Release and waiver of claims
In consideration of being permitted to enter and participate at any Courtline location, I, for myself and my heirs, estate, representatives and assigns, release and waive claims against Courtline and its owners, directors, officers, employees, coaches, instructors, agents, contractors, volunteers, affiliates, landlords and facility partners (collectively, the “Released Parties”) arising from my participation or use of the premises, including claims relating to personal injury, illness, death, or property loss or damage, even where caused or contributed to by negligence of a Released Party.
This release is intended to be as broad as Ontario law permits. It does not release liability that cannot legally be excluded or limited.
Indemnity
To the extent permitted by law, I agree to indemnify and hold the Released Parties harmless from claims, losses, liabilities, damages, costs and reasonable legal expenses arising from my unlawful conduct, intentional misconduct, breach of Club rules, or damage or injury I cause to another person or property. Where I sign for a minor, this provision applies to claims arising from conduct for which I am legally responsible.
Emergency medical assistance
If injury or illness occurs and I am unable to provide consent, I authorize Courtline to contact emergency services and provide reasonable assistance until qualified medical help arrives. If I sign for a minor, I provide the same authorization for that participant. I understand that Courtline cannot guarantee the availability or outcome of medical assistance and that I am responsible for costs not covered by applicable insurance.
Fitness to participate
I confirm that I—and any minor participant for whom I sign—am physically and medically able to participate safely, or have obtained appropriate medical advice before participating. I will disclose information reasonably necessary to respond to an emergency, use required protective equipment, participate within my abilities and stop immediately if I experience pain, dizziness, shortness of breath or another warning sign.
Facilities, equipment and instructions
I will use courts, facilities and equipment responsibly and only for their intended purposes. I will follow posted rules, safety notices and reasonable instructions from Courtline staff. I will promptly report damaged equipment, unsafe conditions, injuries and incidents. I understand that ignoring instructions, misusing equipment or engaging in unsafe behaviour may lead to removal, suspension or termination of access.
Photography and video
Participation in this waiver does not automatically require consent to promotional photography or video. Courtline may request separate, optional permission to use a participant’s identifiable image, likeness, voice or recording for marketing or promotional purposes. Event or facility notices may identify areas where general photography is taking place. Questions or requests concerning an image may be sent to terms@courtline.ca.
Minors and parental responsibility
If the participant is under 18, I confirm that I am their parent or legal guardian and have authority to complete this waiver. I understand the nature of the activities and consent to the minor’s participation. I will ensure that the minor follows Club policies and supervision requirements, and I will remain on-site or accessible when required by the applicable program.
I understand that the enforceability of a parent or guardian’s release of a minor’s claims may be limited by law. Nothing in this document is intended to waive a minor’s rights where such a waiver is not legally enforceable.
Personal property
I am responsible for personal belongings brought to the Club. To the extent permitted by law, Courtline is not responsible for lost, stolen or damaged personal property unless the loss results from liability that cannot legally be excluded. I will secure valuables and use storage areas at my own risk.
House rules and respectful conduct
I agree to follow Courtline’s House Rules and Code of Conduct as posted at the facility, presented during registration or otherwise communicated to me. These may address court etiquette, safe play, footwear, equipment, food and beverages, change rooms, guests, animals, personal belongings, harassment and respectful conduct. Material or repeated non-compliance may result in suspension or termination of access.
Ontario law and severability
This waiver is governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Subject to rights that cannot be altered by agreement, the courts of Ontario will have jurisdiction. If any provision is found invalid or unenforceable, it will be modified or severed only to the extent necessary, and the remaining provisions will continue to apply.
Acknowledgment and acceptance
By signing electronically or physically, or by selecting the acceptance box presented during registration, I confirm that I have read this entire document, understand it, have had the opportunity to ask questions and obtain independent advice, and voluntarily agree to it. I understand that this document affects legal rights, including the right to sue or claim compensation.
If signing for a minor, I confirm that I am the participant’s parent or legal guardian, consent to their participation and agree to the provisions that lawfully apply to me and the minor.
